1. Use of the Website

Welcome to www.khalaifat.com (the "Website"), owned and operated by Khalaifat Company W.L.L. ("Khalaifat", "we", "our", "us"). These Terms and Conditions (the "Terms") govern your access to and use of the Website and the products and services available through it (collectively, the "Services").

By accessing the Website, you warrant that you are legally entitled to do so. When placing an order, you undertake that all details you provide are true and accurate, that you are an authorised user of the payment card used to place the order, and that sufficient funds are available to cover the cost of the goods.

You must be at least 18 years of age to register an account or place an order on the Website. If you are under 18, you may use the Website only with the involvement and consent of a parent or legal guardian, who must place any order on your behalf.

You will be asked to confirm your acceptance of these Terms during checkout. If you do not accept these Terms, you will not be able to place an order. We recommend that you save or print a copy of these Terms for future reference.

Access to the Website is permitted on a temporary basis. Khalaifat reserves the right to withdraw, restrict, or amend the Services without notice and will not be liable if the Website is unavailable at any time or for any period.

The Website may contain links to third-party websites ("Linked Sites"). Khalaifat has no control over Linked Sites and accepts no responsibility for them or for any loss or damage arising from your use of them.

2. Prohibited use

You must not misuse the Website. You will not: commit or encourage a criminal offence; transmit or distribute a virus, trojan, worm, logic bomb, or any other malicious or technologically harmful material; hack into any aspect of the Services; corrupt data; cause annoyance to other users; infringe the proprietary rights of any other person; send unsolicited advertising or promotional material ("spam"); or attempt to affect the performance or functionality of any computer facilities of or accessed through the Website.

Any such breach may constitute a criminal offence under the laws of the Kingdom of Bahrain. Khalaifat will report any such breach to the relevant law enforcement authorities and will cooperate with them, including by disclosing your identity where required.

Khalaifat will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses, or other technologically harmful material that may infect your equipment or data due to your use of the Website or your downloading of any material from it or from any Linked Site.

3. Intellectual property, software and content

All intellectual property rights in the software and content (including photographic images) made available on or through the Website remain the property of Khalaifat or its licensors and are protected by the copyright laws of the Kingdom of Bahrain and international copyright treaties. All such rights are reserved.

You may store, print, and display the content supplied solely for your own personal, non-commercial use. You may not publish, manipulate, distribute, or otherwise reproduce, in any format, any of the content of the Website, nor use any such content in connection with any business or commercial enterprise.

4. Terms of sale

By placing an order, you are offering to purchase a product subject to these Terms. All orders are subject to availability and confirmation of the order price.

4.1 Formation of contract

When you place an order, you will receive an acknowledgement email confirming receipt of your order. This acknowledgement does not constitute acceptance of your order. A contract between you and Khalaifat is formed only when Khalaifat sends you a dispatch confirmation (by email or SMS) confirming that the goods you ordered have been dispatched. Only the goods listed in the dispatch confirmation are included in the contract.

4.2 Pricing

All prices displayed on the Website are in Bahraini Dinars (BD) and are inclusive of Value Added Tax (VAT) at the prevailing rate under the laws of the Kingdom of Bahrain.

Delivery charges, where applicable, are shown separately at checkout before you confirm your order. Delivery is free of charge for orders above BD 50, in accordance with our Shipping and Delivery Policy.

Prices may differ between Khalaifat physical stores and the Website. You will be charged the price displayed on the Website at the time of your order, and Khalaifat is under no obligation to honour any in-store price or promotion that differs from the Website.

Khalaifat reserves the right to change prices at any time and to correct pricing errors that may inadvertently occur. If a pricing error affects your order, we will contact you before dispatch to give you the option of reconfirming the order at the correct price or cancelling it. If your card has already been charged and the order is cancelled, Khalaifat will refund the full amount charged to your card. The timing of the credit is subject to your bank's policies.

4.3 Availability

Stock availability shown on the Website changes dynamically. If any product you have ordered is out of stock for any reason, you will be informed by email and given an estimated availability date, with the option to wait, choose an alternative, or cancel that item for a full refund of any amount paid for it.

4.4 Promotional codes, digital coupons and gift vouchers

Promotional codes and digital coupons are debited at the time an order is placed. Digital coupons and gift vouchers are automatically applied to the purchase total, up to the total purchase amount, must be used before their stated expiry date, and must be redeemed within a single transaction.

5. Shipping, delivery and installation

Our Shipping and Delivery Policy sets out how orders are delivered and can be found on this Website. Delivery is free of charge for orders above BD 50; charges for other orders are shown at checkout.

For products requiring installation, the applicable procedures are set out in the Installation Guide on this Website.

6. Payment

Upon receiving your order, we carry out a standard authorisation check on your payment card to ensure sufficient funds are available. Your card is debited upon authorisation, and the amount received is treated as a deposit against the value of the goods. Once the goods have been dispatched and the dispatch confirmation sent, the deposit is applied as payment for the goods listed in the dispatch confirmation.

If you prefer not to pay online, you may choose Cash on Delivery (COD) and pay in cash at the time of delivery, subject to the Shipping and Delivery Policy.

Alternatively, you may place an order online and collect it from a specified Khalaifat store using the Store Pickup facility. Store Pickup cannot be combined with COD.

7. Returns, exchange and cancellation

Unused items may be returned within 15 days of purchase, provided they are in their original condition and packaging. Approved returns are issued as a credit note; cash refunds apply where a suitable replacement item is not available. Full procedures and requirements are set out in the Refund, Exchange & Cancellation Policy on this Website.

Nothing in this section or that policy affects your statutory rights in respect of defective or non-conforming products, which remain eligible for repair, replacement, or refund in accordance with the Consumer Protection Law of the Kingdom of Bahrain (Law No. 35 of 2012).

8. Warranty

Appliances are covered by a manufacturer's warranty of one (1) year from the original date of purchase, unless a different period is specified on the product description or warranty card. Extended warranty plans may be purchased at the time of sale. Kitchen cabinets and installation work are covered by a five (5) year warranty as standard.

To obtain manufacturer warranty service, contact the manufacturer or its authorised service centre for problem determination and service procedures. Warranty service may only be performed by the manufacturer's authorised service centre. The original dated invoice must be presented as proof of purchase; Khalaifat is unable to re-issue invoices once the original has been issued.

Warranty coverage applies within the Kingdom of Bahrain only, unless otherwise specified on the warranty card or the Website. For manufacturer warranties, Khalaifat acts as facilitator; primary responsibility for manufacturer warranty service rests with the brand, manufacturer, or distributor. For selected products with international warranty, refer to the international warranty card.

Where a product is defective or requires repair, deliver the product to a Khalaifat designated collection centre in selected Khalaifat showrooms and service centres in the Kingdom of Bahrain. For products with on-site warranty support, call our call centre to register the complaint for on-site service.

Free gifts provided with a purchased product are not covered by warranty and are not exchangeable.

Repairs cannot be accepted if the serial number on the product is missing or has been tampered with.

Except for the express warranties stated above and those provided by the brand, manufacturer, or distributor, and without limiting your statutory rights under the Consumer Protection Law (Law No. 35 of 2012) and other applicable laws of the Kingdom of Bahrain, Khalaifat makes no additional warranties or representations in respect of the products listed or displayed on the Website, and product information and specifications are provided by manufacturers and may change without notice.

9. Disclaimer of liability

The material displayed on the Website is provided in good faith. Khalaifat has taken care to describe and show products as accurately as possible; however, product images are for representation purposes only and actual products may vary slightly. Product descriptions and performance details are based on catalogues and technical literature issued by manufacturers or their agents and may change without prior notice. If there is anything you do not understand, or if you require further information, please contact customer service (see Section 15).

To the fullest extent permitted by the laws of the Kingdom of Bahrain, Khalaifat shall not be liable for any indirect, special, consequential, punitive, or incidental damages, or damages for loss of use, profits, data, goodwill, or reputation, arising out of or related to the use of, inability to use, or performance of the Website or any Linked Site.

Nothing in these Terms excludes or limits Khalaifat's liability for death or personal injury caused by its negligence, for fraud, or for any liability that cannot be excluded or limited under the laws of the Kingdom of Bahrain, including your statutory rights as a consumer.

10. Linking to this Website

You may link to the Website provided you do so in a way that is fair and legal and does not damage or take advantage of our reputation. You must not establish a link in a way that suggests any form of association, approval, or endorsement by Khalaifat where none exists, establish a link from a website you do not own, or frame this Website on any other site. Khalaifat reserves the right to withdraw linking permission without notice.

11. Trademarks and third-party content

Except where expressly stated to the contrary, all persons (including their names and images), third-party trademarks, and content, services, and/or locations featured on the Website are in no way associated, linked, or affiliated with Khalaifat. Trademarks and brand names featured on the Website are the property of their respective owners and are used solely to describe or identify the relevant products and services.

12. Indemnity

You agree to indemnify, defend, and hold harmless Khalaifat, its directors, officers, employees, consultants, agents, and affiliates from any and all third-party claims, liability, damages, and costs (including reasonable legal fees) arising from your misuse of the Website or your breach of these Terms.

13. Variation and severability

Khalaifat may at any time amend, remove, or vary the Services and/or any page of this Website. The version of these Terms in force at the time you place an order applies to that order.

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect. Where possible, the unenforceable provision shall be severed or interpreted in a manner that most closely reflects its original intent as permitted by law.

14. Applicable law and jurisdiction

These Terms, and your access to and use of the Website and any purchase made through it, are governed by and interpreted in accordance with the laws of the Kingdom of Bahrain. The courts of the Kingdom of Bahrain shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Website.
